pichunte Terms of Service: Legal Agreement for Platform Use

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and pichunte ("we," "us," "our," or "pichunte") regarding your use of our Service. Your use signifies your unconditional acceptance of these Terms and any future modifications we may publish.

The Service is provided "as is" and "as available." We do not guarantee the accuracy, completeness, or usefulness of any information presented through the Service, nor do we endorse the opinions or conduct of any User. You are solely responsible for your interactions with other Users.

3. User Responsibilities & Account Conduct

To use the Service, you must be at least 18 years of age and have the legal capacity to enter into a binding contract. By creating an account, you represent and warrant that you meet these eligibility requirements.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

You retain ownership of the content you submit, post, or display ("User Content"). By submitting User Content, you grant pichunte a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, and display such content in connection with operating and providing the Service.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall pichunte, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

1. Your access to or use of or inability to access or use the Service.
2. Any conduct or content of any third party on the Service.
3. Any content obtained from the Service.
4. Unauthorized access, use, or alteration of your transmissions or content.

Our total cumulative liability to you for all claims arising from or related to the Service shall not exceed the amount you have paid to pichunte, if any, in the twelve (12) months preceding the event giving rise to the liability, or one hundred dollars ($100.00 USD), whichever is greater.

6. Disclaimer of Warranties

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. pichunte expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

1. The Service will function uninterrupted, secure, or available at any particular time or location.
2. Any errors or defects will be corrected.
3. The Service is free of viruses or other harmful components.
4. The results of using the Service will meet your requirements.

No advice or information, whether oral or written, obtained by you from pichunte or through the Service shall create any warranty not expressly stated in these Terms.

7. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us or using the account deletion tools within the Service.

8. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered by a recognized arbitration institution in London, United Kingdom. The arbitration shall be conducted in the English language. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

Notwithstanding the above, we reserve the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent or stop any actual or threatened unauthorized use or abuse of the Service, or infringement of our intellectual property rights.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
